Landlords and Tenant

Our litigation team will work hard to ensure your interests are well protected.

At BES Legal Ltd, we understand that whatever the size of your portfolio, letting a property is far from straightforward. With vast experience in advising landlords and tenants of both commercial and residential properties and a business-focused background, our litigation team will work hard to ensure your interests are well protected.

There are now over 50 Acts of Parliament and more than 70 sets of regulations governing the private-rented sector and navigating these can be both time-consuming and confusing. Failure to follow the correct procedures or acting in a way that deviates from any essential aspect of the relationship between tenant and landlord, could lead to costly disputes.

At BES Legal Ltd, our team advises both landlords and tenants in relation to agreements for lease (including pre-lets), leases, re-gearing of leases, lease renewals, assignments, authorised guarantee agreements, licences, rent deposits and surrenders.

Management and Drafting

At BES Legal Ltd, our litigation solicitors understand the difficulties that face Landlords and believe that it is vital to ensure that Landlords meet their responsibilities from the outset.

The perception of the modern day landlord is very different from the reality and that they must clear numerous obstacles before the first rent payment even arrives. Before receiving the first payment of rent, the careful landlord must:

  • Buy the property once the appropriate funding has been sourced.
  • Fix the appropriate rent.
  • Check the property and put right anything which is unsafe.
  • Redecorate or refurbish the property – if relevant.
  • Arrange an initial and then annual gas safety checks.
  • Make sure that any furniture, etc, supplied with the let satisfy the Regulations.
  • Arrange an initial inspection of the electrical wiring and electrical equipment.
  • Find a Letting Agent if required.
  • Find a Tenant.
  • Take up reference and guarantees.
  • Ensure that the requirements of the Tenancy Deposit Scheme are met.
  • Enter into an AST agreement with the Tenant.

By ensuring that Landlords are well informed we can prevent costly disputes from arising. Our litigation solicitors are well-versed in all aspects of the landlord and tenant relationship, regularly advising on:

  • Preparation, negotiation and approval of new leases, including renewals under the Landlord and Tenant Act.
  • Assured and assured shorthold tenancies, Rent Act and all residential tenancies.
  • Repairing obligations and dilapidations.
  • Granting and taking leases.
  • Transfer of leases.
  • Renewal of leases.
  • Variation of leases.
  • Subletting of leases.
  • Break clauses.
